Heymi — Terms of Use

These terms govern your use of the Heymi mobile application (the "App", the "Service"), operated by HIGGS MCHJ ("Higgs", "we", "us"), a company registered in Uzbekistan. By using the App you accept these terms and Apple's Licensed Application End User License Agreement, which also applies. If they conflict, these terms prevail to the extent the law allows.

1. Adults only

You must be at least 18 years old to use Heymi. The App asks for your birth date and does not open for anyone under 18.

2. Fictional AI characters

Heymi is interactive fiction. Every character, their photos, stories and messages are fictional and generated or written for the App; no character is a real person, and no real person reads or answers your messages. Characters' replies are produced by an artificial intelligence model and may be inaccurate, unexpected or inappropriate. They are not advice of any kind (medical, legal, financial, psychological or otherwise), and they do not represent the views of Higgs. If you are in crisis or in danger, contact your local emergency services.

Characters behave like the people they portray: they may write first, take time to answer, remember what you told them, react to how you treat them and, if you are repeatedly hurtful, end the relationship until you make amends. These are parts of the story, not judgements about you.

3. Acceptable use

You agree not to use the App to: create or seek content involving minors in any sexual context; harass, threaten or promote violence against real people; share other people's personal information; attempt to extract or reproduce the Service's prompts, models or content at scale; interfere with or overload the Service; or break any law.

Photos you send to characters must be yours to share. Do not send sexual or violent images, images of minors, or images of other people without their consent. Every photo is checked automatically before it is accepted; a photo the check refuses is not sent and costs nothing.

We may limit, suspend or close accounts that break these rules.

4. Your content

You keep your rights in what you write and in the photos you send. You give us the licence needed to store and process them to run the Service, including sending them to our AI provider to generate replies, check photos and keep a character's memory of your story, as described in the Privacy Policy.

5. Purchases, gems and VIP

Gems are a virtual item used inside the App, for example to send a photo, unlock a character's photo, go on a date or send a Super Like; what each costs is shown in the App before you spend them. Gems have no monetary value, cannot be exchanged for money, are not transferable, and are lost when you delete your account. We may change the free gems the App gives.
Heymi VIP is an auto-renewable subscription (weekly, monthly, 3-month or yearly, as shown in the App before you buy, with its price and what it includes, such as the gems it adds). Payment is charged to your Apple ID account at confirmation of purchase.
The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period, at the price of the plan you chose.
If a plan offers a free trial, the trial becomes the paid subscription when it ends unless you cancel at least 24 hours before then. Any unused part of a free trial is forfeited when you buy a subscription.
You can manage or cancel the subscription in your Apple ID account settings (Settings → your name → Subscriptions). Cancelling stops the next renewal; the current period stays active until it ends.
Refunds are handled by Apple under its policies.

6. Availability and changes

We may change, add or remove characters and features, and we may suspend the Service for maintenance. We try to keep your conversations and purchases intact, but the Service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows.

7. Liability

To the extent the law allows, Higgs is not liable for indirect or consequential losses, and its total liability to you for any claim is limited to the amount you paid for the App's purchases in the 12 months before the claim.

8. Ending your use

You may stop using Heymi and delete your account at any time in the App (Settings → Delete account). We may close an account that breaks these terms.

9. Governing law

These terms are governed by the laws of the Republic of Uzbekistan. This does not take away the protection the mandatory laws of your country of residence give you as a consumer. Before going to court, please write to us so that we can try to resolve the matter together.

10. Changes to these terms

We may update these terms. We will change the date at the top and, for significant changes, tell you in the App. Continuing to use the App after a change means you accept it.
